Under the Turkish Law, to grant power of attorney (PoA) to a lawyer for the representation of you in various matters such as legal disputes, property management and other business or personal transactions, power of attorney must be drafted and signed before Turkish Notary.
If you are a foreigner who will grant a PoA before Turkish Notary in Turkey, you need to provide your official identification document such as your passport and your lawyer’s personal info. Also, if you are a foreigner, a sworn translator must accompany you in the Notary to translate the scope and the content of the PoA that you are granting.
If you are not in Turkey and you would like to issue the PoA abroad, generally there are two ways which you can follow.
- Granting a PoA through the Turkish Embassy or Consulate in your country
If there is Turkish Embassy or Consulate in your country of residence you can grant the PoA by making an appointment and notarize the PoA in the Turkish Embassy or Consulates that will act as a Turkish notary abroad. The procedure and the documents are similar to granting PoA in Turkey but please note that it is important to check necessary documents from Consulate’s website and ask your lawyer for a draft in advance.
- Granting a PoA through your local notary
Turkey is a signatory party to 1961 Hague Convention. If you also live in a country that is a signatory party to the Convention, you can grant the PoA in your local notary and apostille the document. Please check https://www.hcch.net/en/states/hcch-members to learn if your country is a signatory.
The steps that need to be followed to grant a valid PoA through your local notary are;
- Ask your lawyer to send you the draft of PoA which is drafted in accordance with Turkish law
- Take this draft to your local notary. Please note that your personal info and your passport copy must be included in the PoA and the notary must add a declaration that he/she confirmed the identification of you by way of your passport.
- Notarized documents must be apostilled by the relevant authority in your country such as the district governorate or the municipality to be used in Turkey.
- The original copy of the apostilled document needs to be sent to Turkey by courier.
- Documents must be translated into Turkish by a sworn translator in Turkey and this translated document needs to be notarized by a Turkish Notary.
If your country is not a party to Hague Convention, the procedure and the necessary steps may vary country to country.
